Innovation Alliance Responds to Administration Position on Patent Reform
Washington D.C. – The Innovation Alliance today responded to the announcement yesterday by the Obama Administration of its current position on patent reform. Secretary of Commerce Gary Locke issued a letter to the leadership of the Senate Judiciary Committee, outlining the Administration’s position on such issues as damages in patent cases and managing the U.S. Patent and Trademark Office.
“We appreciate the Administration’s endorsement of the compromise on damages worked out in the Senate Judiciary Committee, the so-called ‘gatekeeper’ compromise,” said Brian Pomper, Executive Director of the Innovation Alliance. “We hope this closes the debate on the damages issue and signals that the Administration intends to work toward consensus on important remaining issues.”
The Innovation Alliance promotes innovation and entrepreneurship as a central pillar of America’s economic strength, with a focus on the U.S. patent system. The U.S. patent system is the indispensible foundation for continued funding and commercialization of America’s engineering ingenuity, and, in turn, a key element of today’s global business culture. As outlined in the U.S. Constitution, the American patent system is the foundation for innovation and economic strength and therefore any change must be approached with caution and forethought. The Innovation Alliance is committed to improving patent quality while protecting and promoting innovation.
“We believe several important issues remain unresolved, including substantive rule making authority and post-grant review. In particular, we need strong estoppel to prevent serial abuse of patent holders through a lopsided post-grant review system,” said Pomper. “And while we do not oppose overall harmonization of patent laws, we believe that harmonization must not be achieved at the expense of American jobs and competitiveness within all business and academic sectors of the U.S. economy.”
